Public statement

About the arrest and freedom of a member of paramilitary group HERNAN TRIZANO

The autonomous Mapuche community Temucuicui, before the inequality of the Chilean courts, we issue to the local, national and international public opinion the following:

1. In the social club of the city of Victoria, on Tuesday, September 4, 2012, while conducting a meeting between private landowner in the area, including Rene Urban, who was assaulted and threatened with guns by Jorge Octavio Temer San Martín (both landowners and usurpers of Mapuche territory) the latter also mentioned publicly to be part of the paramilitary and terrorist right-wing group Commando Hernán Trizano, who was also one of those who participated in the security summit.

2. We recall that this fellow in July 2009, issued a lengthy interview in the newspaper “Las Noticias” of the city of Victoria, claiming to belong to the paramilitary group Commando Hernán Trizano, publicly threatening to kill and to blow up dynamiting several emblematic families of the Mapuche struggle, including Queipul and Huenchullan both of our community, which constitutes for us as a threat that undermines the integrity of our leaders and of a terrorist nature.

3. Our community before the public threats of this fellow, has presented different types of resources and lawsuits, being all rejected and filed by the Court of Guarantee, the Office of Public Prosecutions and military prosecution, leaving this serious crime unpunished, citing that there was no evidence to initiate any criminal action, and leaving it clear that justice is impartial, since always the Mapuche are being persecuted, claiming that we are terrorists, without evidence or arguments, this being confirmed in court decisions but in the case of some of this country's rich, with evidence, threats, with weapons of war to commit terrorist crimes or attacks, everything goes absolutely unpunished.

4. Finally and as the result of a threat against a private individual, his house was searched finding there a lot of weapons, thus being clearly demonstrated that there is indeed this paramilitary group, that the threats made earlier might have been real and the arson attacks are of their sole responsibility, which aims to blame the Mapuche communities, criminalizing and judicializing the just demands of the Mapuche people.

5. We categorically reject the attitude taken by the Chilean justice with this dangerous person, as he, despite having an arsenal of heavy caliber weapons, including assault rifles with telescopic sights for use by snipers, rocket launchers, and other weapons used exclusively by the military (neither for civilians nor for collectors) along with having assaulted and threatened with death, is released, and in this regard, in the case of arrests of Mapuche community members, justice applies in all cases the full extent of the law, applying the Anti- Terrorism Act (for alleged unlawful associations) or of State security law, and held in custody for long years, adding to the complaints and setups by the state authorities, the Home Office, the mayor, and others who do nothing more than reflect the racist trend of the political practices, which after years of processes have been dismantled, the Mapuche community members being acquitted.
  
6. We demand that this individual is treated in the same way as the Chilean state treats Mapuche community members, let the Anti-Terrorism law be applied, for the large amount of weapons found in working order (ready for use) and the danger that this individual poses to society, and let the government authorities speak out, not defending or justifying it, but simply fulfilling the functions that correspond to their positions.

This Saturday, September 1, the Mapuche Ceremonial Center Relmu Rayen Chod Lafken, located next to the Botanical Gardens in Viña del Mar, was visited by two important and renowned werkén coming from the south of the country: Daniel Melinao and Jaime Huenchullán. After an open lunch, and after playing palín listening to music against the repression of the indigenous peoples, they spoke with the townspeople about the stage currently faced by the mobilized Mapuche people.

"It's nice to come here to this lof, to enter without any problem," said Daniel Melinao, werkén of the Community Wente Winkul Mapu of Ercilla, known by the militarization, violent raids, political persecution and imprisonment that it has suffered in recent times. "Children were injured, elderly, women who are battered. Something that they can do nowhere else in this country. Here there is clearly a degree of discrimination against our people and our village." explained Melinao.

Today this community demands 2,500 hectares that are held by forestry enterprises and individuals. "How does the government respond, with a clear history of these lands belonging to our people because it belonged to our ancestors, Melinao asked, then answered: "The first thing the state does is repress and imprison us." In fact, as noted, today five community members are in the prison of Angol, three of them awaiting trial and two sentenced to 11 ½ years in prison on charges of attempted murder against police.

Suspiciously, Melinao uncovered: "It was police who testified before the judges and they did not show any paper, antecedents or medical paper showing that they had even a scratch, pellet wound or whatever. We believe it is a strategy of the prosecution, because neither their protected witnesses nor the use of the Anti-Terrorism Act are paying off for them. Now they use police officers, they arm setups and go to testify later before judges who think they do not lie, but what they speak are pure lies." said Daniel, about the situation of his imprisoned community members, who this September 4th fulfill nine days on hunger strike to demand the reduction of their sentence, which they consider racist and discriminatory.

 
"As Mapuche we will continue to fight, a conviction, a death, that does not mean we're going to step down. We will continue until recovering the tiniest bit of land that today the forestry companies and multinationals are holding, stolen from us." said the Werkén of Ercilla.

The dispossession

In turn, Jaime Huenchullán, member of the also violated Autonomous Community Temucuicui, referred to the dispossession of their lands. "It was in a violent manner and through deception, by fraudulent legislation, that our community was the subject-like many others-of land usurpation," he denounced, while stressing that this is why his grandparents, parents and children today defend and reclaim what was taken from them by the state, declared state-property and given to international corporations.

He also corroborated Melinao's words about the violence they suffer. "We also have had to live through imprisonment, persecution, harassment, intimidation, daily provocation made ​​primarily by private individuals, accompanied by military police, sent by the government." stated one who is familiar with this reality, after being accused of several attacks against businessman-farmer René Urban, what meant that he had to go into hiding and later being arrested. 

Huenchullán also emphasized the historic resolution that only days ago acquitted eight members of his community in the trial for the alleged theft of a toll in Quino, near Temuco. The Mapuche group, however, had to spend two years in jail. "There is a prepared collusion from the government, the police, prosecutors, employers, the media of the area to raise a campaign to demonize our struggle, to show society that we are violent," said the community member, adding: "Here the only violent ones, the only ones who have stolen, the only ones who have killed, are the state, its policies and all its institutions."

Chilean State continues to imprison Mapuche youths


Leonardo Quijón Pereira of the community  Chequenco and Gabriel Valenzuela Montoya of the community Winkul Mapu Wente have presented themselves voluntarily on September 3rd to the PDI of Angol to make declarations for the alleged charges of involvement in the death of a farmer. Luis Marileo of the Community Cacique José Guiñon also has just present himself to the PDI of Angol voluntarily to make his statement.

Today at the Hearing they were sent to jail for the four months of investigation. Despite his serious health condition Leonardo is imprisoned in the common jail of Temuco. Gabriel was transferred to the jail of Chol Chol. Do not forget that despite the plight of Leonardo's health, malnutrition, his leg full with pellets, with daily, constant pain and a weakened immune system, they destined him to stay in jail with common prisoners, not yet being punished or proved of having been involved in the events. The statements and press reports are vague and very different. This is a result of the systematic persecution of Mapuche youths who the Chilean state dislikes and  who the Chilean state uses their "Justice" against, to try to put out the struggle of the Mapuche people.

Leonardo is charged for allegedly attempting to burn a few pastures according to the press, for which he has to stand trial tomorrow, this is another lie, this is a simple stupidity of a neighbor who has complained because she disagrees with the life of this boy, he is innocent! He and his family have been constantly harassed. It is very important to see how these events are following one another, we must remember that this starts with the destination of Peña to the Araukania.  
The health situation of Leonardo has not progressed over two years, absolutely nothing. On his visits to doctors or emergency clinics, they say he is okay, others say that they can not do anything, the people involved in this do not provide the medical reports needed to to look for other forms of recovery.
Here it smacks of irregularities that for for the time being we have given over to some people involved in this, more regarding this soon.  
Now, I do not want to clarify everything regarding the news of the national press about the case of the farmer, you can all see that for yourselves.

It is clear that the Chilean state makes setups against the Mapuche that unfairly persecute and imprisons Mapuche youths for fighting for their rights, it is clear that the Mapuche is listed as a terrorist for fighting for life, it is clear that they want to kill the Mapuche and even more the children and young people who are the seed of life. Now they try to invent criminal cases against the youths to give yet another complexion to the fight in the reclamation process. The youths who are involved in this case of the farmer are at ease because of their innocence, but despite being innocent they are imprisoned.

Let's not stay calm, innocence does not count if one is Mapuche, an adequate defense is necessary, and for that you need financing. I tell you this as there is a campaign for the Community Wente Winkul Mapu for the financing of the defense. But as it is, Leonardo does not belong to that community and he and his family lack support for a lawyer. I call you to get active and alert on the situation of the young Mapuche. To not only expose these irregularities but also to seek urgently for ways to improve Leonardo's state of health, to get him at least transfered close to the family, where they can visit him, to make them guarantee a health care for Leonardo.
 
We need real support for these young people. It is not too late. We can not wait for months or years of investigations, usurping years of their lives and that later they get declared innocent.

 The implementation of political setups against young Mapuche

Patricio Queipul, Community Temucuicui, Luis Marileo and Jorge Marimán, Community Cacique José Guiñón; Cristian Cayupan and José Ñirripil, Lof Muko, Daniel Levinao and Paulino Levipan, Community Wente Winkul Mapu; Leonardo Quijón, Community Chequenco. These are some of the youths lately harassed, persecuted, prosecuted and convicted by the Chilean state for being Mapuche and defending their ancestral rights.

Each of these young men were prisoners in jail with exception of the minor Patricio Queipul who was two years in hiding until the April 29, 2011 when he was violently arrested.
A childhood marked by raids, by police violence against them and their family, thinking that may be wounded or killed, facing discrimination by a large segment of the Chilean community by the political influence of the government. of the state.
The press is manipulated and controlled. The aim of the state is to criminalize the social struggle of the Mapuche communities fighting for their ancestral rights to secure its own economic interests.
Compounded further by the application of the Terrorism Act inherited from the time of the dictatorship including minors, in violation of all rights in the Convention of the Child that Chile ratified 22 years ago.

Daniel Levinao and Paulino Levipan were sentenced to over 11 years for alleged attempted murder to policemen and illegal possession of weapons. The Court of Angol condemns them on August 8, 2012 despite that no evidence exists proving their involvement in the incident. The Chilean Justice decides to condemn them with evidence such as the use of props using dummies where policemen recognized the clothes the young community members wore that day, versions that contradict those of the previous day.

Proceedings that are approaching under the Anti-Terrorism Act on 4 and 5 September.

Cristian Cayupan and José Ñirripil must present themselves at the Preparation of Oral Proceedings in the case Attack on the Fundo Brazil, events that occurred on September 11, 2009, on charges of alleged terrorist arson, common arson of consummate and frustrated degree and robbery with intimidation. Recall that at the time they were children, and as in the Toll Quino case a separate process from the adults is applicable.

Leonardo Quijón, the young Mapuche wounded with almost 200 pellets in his leg, unjustly prosecuted and later acquitted in 2009. Again is charged with alleged attempted arson at a property and the trial will be held on September 5, 2012 in Collipulli.
Leonardo's case is one of the most serious cases of human rights violation and yet no one is made responsible for them, especially in spite of his proven innocence the Chilean state, instead of doing Justice they keep harassing and persecuting him. August 23 at 16:00 pm he was arrested by Chilean PDI and he had to spend a night in a cell despite aggravating his health situation caused by wounds from the pellets in his leg.

Although it has been shown that these trials are unfair, improper and Public Prosecutor's accusations are unfounded, wrongful convictions have been exercised as in the case of the youths Levinao and Levipán
and the Mapuche continue to be prosecuted and convicted for supposed facts while in the murdercases of Mapuche, as in the case of community members Jaime Mendoza Collio and Matías Catrileo, the murderers stay free and continue to work as police. 

We call to support the young Mapuche subjected to these trials and to denounce nationally and internationally the Chilean state for these undue trials that do not respect the international treaties.
Demand an end to the application of the Anti-Terrorism Act against the social struggle and the end of terror and violence against Mapuche communities and their children.

OCCUPATION OF UNICEF-CHILE ENDS ... BUT THE STRUGGLE CONTINUES!

After 39 days of occupation and 10 days on hunger strike on the premises of the UNICEF-Chile and after obtaining the commitment of this institutions representative, Tom Olsen, of going to the region of Ercilla and observe in place the complaints that prompted this action of force and pressure, the Mapuche representatives abandoned the UNICEF-Chile Headquarters.

Mewlen Huencho, the Werkén (spokesperson) of this group of women from the Mapuche Territorial Alliance, is now traveling towards Ercilla to await UNICEF so this international organization may take note of the gravity of the situation.

Werkén Mewlen Huencho: "This is not the end, since they have just committed new acts of violence against the Mapuche people and there is also the hunger strike in jail for Mapuche political prisoners. The political prisoners of the community Wente Winkul Mapu of Lof Chekenco: Paulino Levipan Coyán, Daniel Levinao Montoya, Hector Ricardo Nahuelqueo Nahuelqueo, Rodrigo Montoya Melinao and their spokesman Eric Montoya Montoya.

We wish to inform the national and international public opinion that:
 
Today September 2, 2012, the seventh day of our hunger strike, we maintain firm our decision to continue our mobilization. Every day that passes we are more convinced of our struggle against this repressive state that has us deprived of our liberty, simply for being Mapuche, part of a people who will never disappear.

The hunger strike is our only weapon to denounce the Chilean state and its racist government, along with their police institutions that repress, imprison and condemn our peñis(brothers), only for thinking and fighting for the just and legitimate right to territory and freedom of our people. We will continue resisting and fighting against the oppressive capitalist system, we will fight against the usurpation of land and go to the end for justice and truth for our cause.

We demand:

1. - A mistrial in the case of Paulino Levipan and Daniel Levinao.
2. - The application of Convention 169 and international agreements signed by Chile.
3. - An end to the use of protected witnesses in Mapuche cases.
4. - No more raids on Mapuche communities and an immediate end to police violence against children, women and elderly.  
   We want the demilitarization of Mapuche territory.
5. - Freedom for all Mapuche political prisoners and the return of the territory to our communities.
