MAPUCHE MARCH IN ANGOL FOR EMBLEMATIC TRIAL

The Mapuche communities in resistance in Malleco, have called for a large march for Tuesday, August 21, 2012 at 9:00 hours from the main entrance of the city of Angol.

There is starting an emblematic trial, against members of the Autonomous community Temucuicui and Cacique José Guiñon, both of the town of Ercilla. The political trial will be held exclusively with the participation of Plaintiff Ministry of the Interior, representing the Government of Sebastián Piñera since the Public Prosecutor stays out of the case.

The march, as reported by Victor Queipul Huaiquil, Lonko (leader) of the Autonomous Mapuche community Temucuicui, will start around 9 hours, from the main entrance of the city of Angol, to the oral court for Criminal Matters of this city, is intended to provide strong support for the 10 Mapuche, who will face a political trial, orchestrated by the Ministry of the Interior.

PUBLIC STATEMENT BEFORE START OF EMBLEMATIC TRIAL AGAINST MAPUCHE


 

The Autonomous Mapuche Community Temucuicui: Hereby we present to the public local national and international the following:

1. - For tomorrow Tuesday August 21, 2012, in the oral criminal court of the city of Angol at 9 am, is scheduled to start the emblematic trial against the villagers José Queipul Huaiquil, Victor Queipul Millanao, Camilo Tori Quiñinao, Felipe Huenchullán Cayul, Juan Huenchullán Cayul, Jose Millanao Millape, members of our community. Also accused are Jorge Marimán Loncomilla, Ernesto Cayupan Meliñán, the latter belonging to other Mapuche communities of Malleco, who are charged with the crimes of robbery, arson,
damages, conspiracy, among others, incidents that allegedly occurred on October 10, 2009 in the sector of Quino, municipality of Victoria.

2. - The main evidence that the Interior Ministry used against our brothers is the declaration of a protected witness (Raul Arturo Castro Antipán) who allegedly participated with all defendants in the events of October 10, 2009. It should be noted that Castro Antipán is protected witness in other cases in which there are charged persons and members of other Mapuche organizations, who receives a monthly salary of  300,000 Chilean Pesos ($620,-) approximately (argument has not been refuted by the prosecution), which to date amounts to twenty causes for various offenses, some even this year and that in most cases Antipán Castro has been acquitted, has been granted conditional suspension or the prosecutor has applied the principle of opportunity not to condemn. In addition, this individual is already convicted of the crimes charged against our brothers, but he applied the rules of the Anti-terrorism Act relating to leniency, allowing him to serving his sentence in freedom. In our view, this sentence only responds to a "strategy" of the Attorney General to give credibility to its witness and was necessary to maintain the charge against our brothers, because his testimony is the main evidence, and so it is a very good deal to accuse unjustly to receive a salary and free custody.

3. - It should be remembered that all the time spent in the research, (3 years), in this case there have been a range of situations that have affected and confronted our brothers, for example a lengthy hunger strike, imprisonment, underground interrogation under torture, searches to the community etc.

4. - This emblematic case, throughout the investigation phase, was held under the Anti-terrorism Act, using all warranty and strategy that the law gives to the prosecutor and the police to investigate, but at the time of the preparation of the trial, the prosecution was unable to sustain its orchestrated set-up and for contempt of court the public prosecutor, Miguel Angel Velasquez, was expelled from the case, being carried out by the Ministry of Interior, who on behalf of the Government seeks to condemn our brothers.

5. - On the other hand, the continued practice of orchestrating set-ups under the Anti-terrorism Act inherited from the Pinochet dictatorship, does nothing more than reaffirm once again how the paranoia of the right wing government and its attempts to criminalize social protest falls in absolute ineffectiveness, since it uses only the repression in all its expressions (legal, communication and police) to maintain the policy of deaf ears and its monologues. 

We extend the call to solidarity networks with the Mapuche cause, to be alert to the development of this emblematic court case, in which we will demonstrate our innocence and try to take the maneuvers and strategies of the state. In the same way we make a wide called to demonstrate, repudiate and denounce this orchestrated trial by supporting us with any form of expression.

It is unlikely that a judgment of this nature can be sustained against a possible appeal to a fairly impartial civil court, however in this case the appeal shall be filed with the Supreme Court which, although it previously has moderated some excessively high sentences issued against Mapuche, no ceases to be a court of justice of the Chilean state, the invader and occupier of our country and present occupier of our Mapuche Country on this side of the mountain range and therefore very little impartial at the time of judging.

On Wednesday, 14, at the Mapuche community center Pelontuwe of the Universidad de la Frontera in Temuco was commemorated the life and death of Weichafe(warrior) Jaime Mendoza Collio, who, while they were trying to reclaim their community lands now occupied by the landowner Jarpa Sergio Gonzalez, was cowardly killed with a shot of an Israeli Uzi rifle in the back by the policeman Miguel Jara Muñoz, who covered by the misnamed forces of order, claimed it was a 9 mm pistol in self-defense. On the side artistic-cultural, was appreciated the poetry of Rayen Kuyen and Alexander Stuart, the Hip Hop trio Rebel Mapu and the always welcome strength in singing and music from Colelo with the group Peumayen, very brilliantly accompanied by a beautiful child of three years who came spontaneously from the public to dance Choike Purrun, and great shouts of the master sound-man Hugo Pena, always present in our musical activities.

Appeals Court will hear Mapuche children 
shot in Collipulli Hospital

By appealing to the provisions of the International Convention on the Rights of the Child, the Mapuche Criminal Defense asked the Court of Appeals of Temuco to hear the story of a group of Mapuche children.

Tomorrow Friday August 17 and before the court minister Alejandro Vera Quilodrán, Mapuche children who were shot in Collipulli Hospital will have the opportunity to show and express what they deem relevant, exercising their right to be heard.

So this is established by the International Convention on Children's Rights and according to the Mapuche criminal defender Maria del Rosario Salamanca, "this right is reinforced for Mapuche children in the ILO Convention 169, in this context the Public Criminal Defense of the Araucanía Region, along with becoming a party of the appeal lodged by the Human Rights Institute for Mapuche children, has asked the Court of Appeals of Temuco to set a special hearing for children to be heard."

This request having been received, tomorrow the Court will receive the children who will talk privately with the Minister Alejandro Vera.

"It is relevant here that a Court of the Republic such as the Court of Appeals hears these children affected by lead shot of the police on July 23 outside the Collipulli Hospital when assisting a visit to their relatives," said the lawyer. 


Stating further that the idea of the defense to make the request, was that "the fulfillment of the right to be heard of the protected children becomes effective" added the lawyer Salamanca.

Public Statement

Faced with the judgment of Mapuche community members.

The Autonomous Mapuche Community Temucuicui , faced with the unjust sentencing of members of the community Wente Winkul Mapu, expresses to the local, national and international public opinion the following:

1. We strongly reject this ruling made known by the Oral Criminal Court of the city of Angol, since this sentence was only the result of the pressures of the big landowners, private individuals and forestry companies to the current government of Sebastián Piñera, who maintain the usurpation of the Mapuche territory.

2. This unjust and false sentence is proof of the practice of intimidation, repression and criminalization the Chilean State uses to stop the just process of struggle for ancestral land and territory carried out by the Mapuche communities.

3. We stand in solidarity and support to the community Wente Winkul Mapu, and onwards also will support all processes of struggle for the freedom of the brothers, now Mapuche political prisoners, and full restitution of the usurped lands.

4. As you can see, the government's strategy discussed in its security summit is beginning to bear fruit, however, we want to make it clear to Mr. Piñera that the Mapuche social movement will not stop because of increasing the number of police in Mapuche territory or the sentencing of our brothers.

Public statement of the Mapuche Community Cacique José Guiñon

Cacique José Guiñon The community of the town of Ercilla, went to La Moneda, to the central government, 
 in order to exhaust the last instances of dialog in which was sought to reiterate our territorial demands, delivering current testimony about the persecution and militarization that this process of demands has led to, besides providing key documents which show that our families and community belonged to which territories in demand.

This journey of the community Cacique José Guiñon, self-managed and carried out by about 35 people including spiritual authorities, children, women and pu peñi (brothers), was made in an effort to establish a direct dialog with the Chilean authorities claiming the word of dialog offered by the government with the various Mapuche communities.

 This visit makes it clear that the Chilean government is This visit makes it clear that the Chilean government lacks the will and even more the disposition for opening direct communication, negating any chance of meeting with higher authorities, to which end we attended 2 days straight looking for this possibility, there was not even the ability to directly deliver the letter to the minister for social development Joaquin Lavin.  
As a last resort we were offered to leave our letter with detailed information of our needs and requests to the undersecretary of the minister mentioned.

This refusal to dialog as well as the constant militarization of the different Mapuche communities and  in addition to the prosecution of our struggle such as the strong and unjust sentencing of two of our brothers in the community Wente Winkul Mapu, who were sentenced to more than 10 years in prison, without police injured or even less dead, which is a demonstration of government power as a means of intimidation to communities in the process of reclaiming. What we believe is not more than just another political trial that seeks to repudiate and nullify our road to territorial recovery, self-determination and territorial autonomy.

We reiterate our support for the Mapuche community Wente Winkul Mapu, besides making a call to the public to show solidarity with this community and the various Mapuche communities victim of an oppressive state, for pursuing their land claims process.

Defense to Appeal Sentence Imposed on Two Mapuche youths

"Indigenous organizations rejected the ten year jail-time sentence imposed on two Mapuche Communers from Aracauinia. Family members qualify the sentence as arbitrary and racist."

Daniel Levinao and Paulino Levipan were condemned by the Chilean courts to 11 years in prison, amid the political onslaught and repression of the Chilean state and capitalist interests in the Mapuche territory.

It is 10 years for "attempted murder" against the general of police Ivan Bezmalinovic and 541 days for "carrying a firearm."

The sentence was announced this Monday in the Oral Tribunal of Angol, where the whole community came together with representatives of other communities in struggle, whose leaders warned that the protests will increase and the prisoners will not be left outside the struggle for territory.

Words of the young Mapuche Leonardo Quijon shot by the Chilean State Police - 2009

Grave human rights violation, Leonardo Quijón shot by police, innocently accused and tried, still no one answers for, and nobody takes responsibility for, the pellets in his body.

On June 19, 2010, after five days of trial against him, the minor Leonardo Quijón Pereira was cleared of all the crimes he was accused of by the Anti-Mapuche prosecution, by means of the Prosecutor of Angol, Luis Chamorro, who during the trial requested a 10-year sentence against the teenager, which is the maximum penalty that can be applied to a minor.

Leonardo, who was arrested in Santiago by the PDI after being long in the Trauma Institute of the capital, had to spend more than 8 months in detention in a Detention Center in the town of Cholchol, accused by the prosecution of robbery, arson, illegal possession of firearm and attempted murder. According to the Anti-Mapuche prosecutor, Leonardo would have participated in an ambush in the area of Alto Cancura, Route Collipulli-Angol, where there were 2 trucks attacked and burned.

Finally, in front of family and members of his community, the judges who saw his case decided to acquit him of the 4 charges against him because the prosecution evidence was insufficient and rightfully absurd. Afterwards he was taken to the detention center of Cholchol where he was released and he went with his family to his Community.

The young Mapuche Quijón Leonardo Pereira was more than a year in prison, innocent of the charges that he was accused of by the Chilean Justice. Leonardo Quijón Pereira, a young Mapuche of the community Chequenco relates the situation, repression, the harassment, persecution by the Chilean state police. Leonardo is one of the young Mapuche discriminated against and persecuted by the Chilean state by virtue of being Mapuche.

The prisoners do not even rule out starting a hunger strike.

Daniel Melinao, werkén (spokesperson) of Wente Winkul Mapu, said this new aggression against communities contrasts with the commemoration of the 3 years after the murder of peñi (brother) Jaime Mendoza Collío at the hands of police, whose murderer remains free.

All this happened in Angol, while in the area of Ercilla, people rallied cutting roads and announcing that the struggle for the restitution of Wallmapu will continue with even more force.
